Loss and
Damage Claim Form At
American West Worldwide Express, your business is important to us. To
ensure your continued business, we take great care to make sure your
product reaches it's intended destination in good condition. Our ZERO
tolerance campaign has brought the majority of our tendered freight to
market damage free. American West Worldwide Express has one of the
lowest claims ratio in the transportation industry. Should your
experience with even one shipment be otherwise, we invite you to read
our claims policy and submit the appropriate form so that you might be
compensated for your loss in accordance with our agreement with you. We
take great pride at handling your product as safely as possible and hope
that we can help you with future shipments, blanket wrap and/or
cartoned.
AMERICAN
WEST WORLDWIDE EXPRESS - CLAIMS POLICY
- Freight charges MUST be paid in FULL before a claim will be
considered.
- ALL claims for loss or damage MUST be filed in WRITING within 90
days of receipt of shipment for Air Freight shipments, and within 9
MONTHS of receipt of shipment for ground and Blanket wrap shipments.
- ANY shortage or damage MUST be noted on the delivery documents, at
time of receipt, for claim to be paid. INSPECTION of ALL items
should be done at time of receipt. ANY NOTATION such as; “Subject
to Recount”, “Subject to later Inspection”, “Items not right
side up” will not be accepted to delay inspection and claim filing
and are INVALID.
- Loss or damage discovered after clear delivery has been given to
carrier, MUST be filed within 7 days of delivery for Air Freight
shipments and within 15 days of delivery for ground and blanket wrap
cartoned/crated shipments or claims will NOT be honored. NO
concealed damage claims are allowed on “Blanket Wrapped”
shipments, since Inspection is Required, as blankets are removed on
delivery.
NOTE: ALL concealed damage claims MUST be filed in
writing with American West within the above time frame or claims
will be DENIED. VERBAL/TELEPHONE communication to the American West
Sales Force and/or our offices or our shipper’s offices is NOT
ACCEPTABLE notification.
- “Special Damage ”, such as loss of production, loss of sales,
stand-by time, contract penalties and similar items, even though
resulting from loss, damage, or delay chargeable to carrier
negligence, shall not be paid unless specified in the contract of
carriage.
- Carrier liability on Air Freight shipments without purchased
“Declared Value” insurance shall be paid at $ 0.50 cents per
pound for loss or damage. If damage is TOTAL – salvage belongs to
carrier.
- Carrier liability on Blanket Wrap shipments without purchased
“FULL VALUE” insurance stated on bill of lading shall be paid at
$ 0.60 cents per pound. Claims on Statuary, art, rare antiques, one
of a kind items, marble, granite, stone or glass, shall NOT be paid.
- Carrier liability on general commodity shipments shall represent
the reasonable destination value and shall be governed by all
applicable tariff provisions. Overhead expenses, destination sales,
distribution, or handling expenses not actually incurred, profit
which is anticipated but is unearned at the time of movement,
packaging materials or similar items included in or added to the
destination value, shall NOT be paid. Claimant should assign a
unique number to each claim and will be provided a carrier claim
number to be used in all correspondence.
All claims are
processed as expeditiously as possible. Your claim will be acknowledge
within 30 days and investigation completed within 120 days or longer
depending on circumstances. ALL necessary documents should be attached
to your claim to speed up handling. |
